Fact Finding Report - Gang Rape

FACT FINDING REPORT

On

Suguna (25) W/o Posha Goud (33) R/o Sangaipur (V) Medak District, Caste Mudiraju Sangaipalli a seven months pregnant woman was gang raped by 15 members in sangaipur village out skirts and husband Posha Goud was attacked who was along with her.

Nature of the offence:        Gang rape (7 Months pregnant women)

Date of occurrence:          31st midnight to 1st early morning  4 o clock (01-01-08)     

 Date when the offence came to light:   02-01-08  

Facts of the case:

 The victim is Smt Suguna (25) by caste (Muddhiraju) was married to Posha Goud (33) R/o Sangaipur (V) Medak District, one year back and is seven months pregnant now, she went with her husband to hospital in Ramayampet and were returning to their home it was night there were no buses so they wear waiting in bus stand, patrolling came their and started beating everyone this couple escaped from them and managed to get in a lorry and dropped in sangaipur bus stand cetnre. An auto came from sangaipur first only three members were there then it went back and brought four more people they told they were cop’s and made the couple sit forcefully in auto and drove to forest area there eight more people joined. Eight members wear beating Posha goud and others attacked and raped Suguna and after some time again they beat him with sticks and rods and raped her again and again.

Husband Posha Goud’s statement:

‘My name is Posha Goud. I’m a residence of Sangaipalli, sangaipur (v) Medak (d) I went to hospital with my wife who is seven months pregnant while coming it was dark we were waiting for bus in ramyampet bus stand patrolling came their and started beating everyone so we escaped from those cop’s and managed to get a lorry which dropped us at sangaipur. It was very cold so my wife asked me to light fire so we might be worm at that time. An auto came from sangaipur first only three members were there then it went back and brought four more people they told they were cop’s and made us to sit forcefully in auto and drove to forest area there eight more people joined. They wear fighting themselves meanwhile we tried to escape then two of them from the group caught hold of us. They wear trying to separate us, I was catching my wife’s left leg one of them beat me with stick on my hand so I left her leg. Eight members beat me black and blue, took all my papers, money threw them in front of auto and raped my wife allegedly again and again right in front of me till morning. I told them I was thirsty so they pore toilet in my hand and I drank. And they gave her langa asked her to wear, they told her its cold & gave her a coat and asked her not to wear coat buttons. I begged someone for ten rupees and called my friend and reported in police station.

                  Sankarampet SI sharrif khan abused me.He also told that he would give 1,600 rupees which accused took away from me, buy me a new cell and give me some more money. Then joined my wife in hospital where we did not get treatment hours together. Sankarampet SI and ramayampet SI first tried to bribe me later forcing me to drope the case. After DSP called SI, accused got arrested.            

Response by the Authorities:

1. Response by the Circle inspector Ramayampet: CI Vijay Kumar told, DSP took up the case,

2. Accused Nine members are arrested but not yet exposed

3. Evidence is collected and the victim is recovering

4. Accused are of twenty to twenty five years of age.

5. I did not get any complain against shankarampet SI sharrif khan.

2. Response by the Doctor Medak District.

·        Doctor K.M. Rajsingh told that he has completed all legal programs and certified.  

·        Patient is stable, will be discharged next evening

·        The baby is healthy and safe.

·         I took scanning also

Findings of the team:

The following are the key findings made by the fact-finding team:

• The victim is a seven months pregnant woman.

• The victim is newly married (one year back).

• Family background also very poor and no supporters from their family members

Standards breached:

• The victims’ right to life which was guaranteed under article 21 of the Indian Constitution was breached and Articles 14 & 15 also violated 

• The victims’ right to freedom of speech and expression, which was guaranteed under article 19 of the Indian Constitution, was breached.

International standards breached:

·        Article 19 gives right of protection from abuse and neglect. 

·        Article 20 gives right of alternative special protection and care.

·        Article 24 provides right of health care services to the woman

Recommendations:

1. All the accused persons should be arrested immediately and cases should be booked under proper sections

2. The victim woman should be provided full protection and safety.

3. The victim who under gone treatment should be examined by a special lady doctor and provide all sorts of immediate and long time medical and health measure to avoid any kind of ill effect on the victims health.  And she should be provided psychosocial counseling by a specialized psychiatrist for a period that the psychiatrist certifies that she is completely in a normal state of mind.
